Terms of Use
These terms govern your use of the Stretchlet iOS app, Stretchlet AI, stretchingapp.com, and related services.
Last updated: September 30, 2026
1. Agreement and eligibility
These Terms of Use (“Terms”) are an agreement between you and Patagonia Capital LLC (“Patagonia Capital,” “we,” “us,” or “our”). By downloading, accessing, or using Stretchlet or stretchingapp.com (together, the “Services”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 13 years old. If you have not reached the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you. You may use the Services only where permitted by law.
The App Store’s terms and the Apple Standard End User License Agreement also apply to the iOS app. If these Terms conflict with mandatory App Store terms, those mandatory terms control for that issue.
2. Wellness and safety
Stretchlet offers general stretching, mobility, habit, and wellness content for informational purposes. It does not provide medical advice, diagnosis, treatment, physical therapy, or emergency services. The Services are not a substitute for a qualified healthcare professional who knows your individual circumstances.
- Talk to a healthcare professional before beginning if you have an injury, health condition, are pregnant, recently had surgery, or are unsure whether an exercise is appropriate.
- Use a clear and stable space, move within a comfortable range, and follow any exercise cautions shown in the app.
- Stop immediately if you experience pain, dizziness, numbness, shortness of breath, or unusual discomfort. Seek urgent help for a medical emergency.
You are responsible for deciding whether and how to perform an exercise. Results vary, and we do not promise a particular fitness, flexibility, pain, or health outcome.
3. Stretchlet AI
Stretchlet AI uses an automated model to select and arrange existing exercises from Stretchlet’s library based on the request and preferences you submit. Generated titles, explanations, sequencing, and selections may be incomplete, inaccurate, unsuitable, or unexpected.
AI output is general wellness content and is not medical advice. Do not ask Stretchlet AI to diagnose symptoms or provide treatment, and do not include personal, medical, or other sensitive information in your request. Review the complete routine and exercise cautions before beginning. You may edit or delete a saved routine.
AI availability, models, limits, credits, response times, and features may change. A successfully completed generation may use a credit; a failed or canceled generation is intended to return its reserved credit. We may reject requests, limit use, or suspend the feature to protect safety, security, service capacity, or legal compliance.
4. Accounts and user content
The app may create a persistent anonymous account so features such as progress, subscriptions, and AI credits can work without an email sign-up. You may choose to link an email and password. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.
You retain your rights in text, feedback, and other content you submit. You grant us a limited, worldwide, non-exclusive license to host, process, transmit, reproduce, and adapt that content only as needed to provide, secure, support, and improve the Services, comply with law, and enforce these Terms. This license ends when the content is deleted from our systems, except for lawful backups, security records, or other required retention.
You can request account deletion from Account Settings. Account deletion does not cancel an Apple subscription. You must cancel the subscription separately through Apple to stop renewal charges.
5. Subscriptions, trials, and purchases
Paid features are sold as in-app purchases through Apple. The price, billing period, trial eligibility, renewal price, and included features shown in the purchase screen and Apple confirmation are the terms of your offer. Apple processes payment and may apply taxes.
Subscriptions automatically renew unless canceled through your Apple Account before renewal. Apple charges the payment method associated with your Apple Account. You can view, change, or cancel a subscription in iOS Settings > your name > Subscriptions, or follow Apple’s cancellation instructions. Deleting the app or a Stretchlet account does not cancel a subscription.
Trials convert to a paid subscription unless canceled before the trial ends. Trial eligibility is determined by Apple and may be limited. Refund requests are handled by Apple under its policies and applicable law. We may change future prices or features with notice required by Apple or law; a change does not alter a period you have already paid for.
6. License and intellectual property
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Services for your own non-commercial wellness use. Stretchlet, its software, design, illustrations, videos, exercise library, branding, website content, and other materials are owned by Patagonia Capital or its licensors and are protected by intellectual-property laws.
You may share routine summaries using features provided by the app. No other right is granted to copy, scrape, republish, sell, sublicense, distribute, reverse engineer, or create derivative products from the Services except where law does not allow that restriction.
7. Acceptable use
You may not:
- use the Services unlawfully, harm others, impersonate another person, or infringe rights;
- submit malicious code, overload or disrupt the Services, bypass rate or credit limits, or attempt unauthorized access;
- probe, scrape, extract, or reverse engineer the Services or exercise catalog except as permitted by law;
- use automated means to create accounts, generate routines, or collect data without our written permission;
- use AI output as professional medical advice or represent it as reviewed for a particular person’s medical condition;
- upload content you do not have the right to use or content that is abusive, deceptive, or illegal.
8. Third-party services, changes, and availability
The Services rely on Apple, Firebase, OpenAI, Adapty, analytics, attribution, hosting, and other providers. Their services and terms may apply. Links to third-party sites are provided for convenience, and we are not responsible for their content or practices.
We may add, change, suspend, or discontinue features; correct content; impose reasonable limits; or release updates required for continued use. We do not guarantee that every feature, routine, or subscription offer will always be available, uninterrupted, secure, or error-free. Internet access and a compatible Apple device may be required.
9. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
To the fullest extent permitted by law, Patagonia Capital and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from the Services, even if advised of the possibility.
To the fullest extent permitted by law, our total liability for claims related to the Services will not exceed the greater of the amount you paid for the Services during the 12 months before the event giving rise to the claim or US $10. These limits do not apply where prohibited, including liability that cannot be limited for fraud, intentional misconduct, or certain personal injury. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
10. Termination, disputes, and other legal terms
You may stop using the Services at any time. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, misuse the Services, or if we discontinue the Services. Sections that by their nature should survive will survive termination, including intellectual property, disclaimers, liability limits, and dispute provisions.
Before filing a claim, contact support@stretchingapp.com and provide enough information for us to try to resolve it informally. These Terms are governed by the laws applicable to Patagonia Capital, without regard to conflict-of-law rules and without limiting mandatory consumer protections available where you live. EU, UK, and other consumers retain rights that cannot be waived by contract.
If any provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, or sale. These Terms, the Privacy Policy, and applicable App Store terms form the agreement concerning the Services.
We may update these Terms. We will change the date above and give additional notice of material changes when required. If you do not agree to revised Terms, stop using the Services.
Questions about these Terms can be sent to support@stretchingapp.com.
